The grievance of the petitioners is that respondents 3 and 4 are interfering with their civil disputes pending with third parties, in respect of the subject property situated at Patamata, Vijayawada, Krishna District.

Learned Assistant Government Pleader for Home produced written instructions, wherein it is stated that there are civil disputes pending between the petitioners and one Atluri Jayaprada Devi. It is stated that the said Jayaprada Devi and her daughter handed over the subject property to M/s. Gearup Dwaraka Infra, Hyderabad, for development. It is stated that in connection with the subject property, the petitioners filed a suit in O.S.No.70 of 2018 before VIII Additional District Judge, Vijayawada, Krishna District, and the learned Judge granted status quo. It is stated that when the petitioners are trying to trespass into the subject land and trying to cut down the trees, on the written report of one P.Praveen Kumar, who has been working as Engineer in M/s. Gearup Dwaraka Infra, Hyderabad, on 08.02.2018, a case in Crime No.
82 of 2018 of Patamata Police Station, Vijayawada, was registered against the petitioners for the offences punishable under Sections 447, 427 and 506 read with 34 IPC and took up investigation. It is stated that aggrieved by registration of above said crime, the petitioners have filed Crl.P.No.3175 of 2018 and obtained stay of all further proceedings including their arrest in the said crime. It is stated that in view of stay granted by this Court, the 4th respondent kept the investigation of the case in abeyance.

Recording the same, the Writ Petition is disposed of directing the respondent-police not to interfere with the civil disputes pending between the petitioners and third parties.
