THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.8600 of 2015 ORDER:

It is the case of the petitioner that her father was appointed as a fair price shop dealer of shop No.14, Kotcherla Village, Ipur Mandal in Guntur District and he died on 29.03.2011. Subsequent to his death, interim arrangements were made and one Anusha DWACRA Group was appointed initially. Based on the allegations, the said group was removed and the petitioner was appointed on temporary basis under Rajiv Yuva Kiranalu. Challenging the appointment of the petitioner, the said group filed W.P.No.2037 of 2013 and the said Writ Petition was disposed of by this Court on 21.01.2014 directing the fourth respondent to issue notification calling for applications from eligible candidates for appointment on permanent basis. Even then, no steps were taken and the sixth respondent was appointed on temporary basis replacing the petitioner. Challenging the appointment of the sixth respondent, the present Writ Petition is filed.

The sixth respondent has been continuing for the last few months and in that view of the matter, this Court does not want to disturb the said arrangement at this stage, though the sixth respondent did not appear even after receipt of notice from this Court in April 2015. However, the fourth respondent is directed to implement the order of this Court dated 21.01.2014 in W.P.No.2037 of 2013 and take necessary steps for filling up of the vacancy caused by the death of the petitioner's father on 29.03.2011 and complete the said process within a period of six months from the date of receipt of a copy of this order. It is open to the petitioner to make an application for appointment on compassionate ground or to apply on her own pursuant to the notification that may be issued by

the fourth respondent.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 05.10.2015 vs
