HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 32169 of 2018 ORDER:
1) Heard learned counsel for the petitioners and Government Pleader for Revenue.
2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.4 in trying to dispossess the petitioners and interfering with the possession and enjoyment of the petitioners in respect of the lands in Survey Nos.731, 732, 733, 845 and 852 of Mamillapalli village and Home Guards colony lands, C.K.Dinne Mandal, Kadapa District, as illegal and arbitrary.
3) At the time when the matter is taken up for hearing, it is brought to the notice of the Court by the learned Government Pleader that the petitioners were trying to raise commercial complex in the subject land, which is Government land and that they obtained possession certificates by deviating the terms and conditions of assignment and misguiding the revenue authorities. 4) Learned counsel for the petitioners would submit that the petitioners would have no objection if the authorities are directed to interfere, if really, the petitioners violated the terms of assignment.
5) Recording the above submission, the Writ Petition is disposed of directing the authorities not to interfere with the possession and enjoyment of the lands of the petitioners, except in accordance with the procedure established by law. 6) Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
