Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies appearing for the respondents.
The petitioner was appointed as fair price shop dealer of shop No.11 of Chagapur Village, Itikyala Mandal, Mahabubnagar District. While so, on the basis of the complaint of the villagers, dated 18.02.2015, the fourth respondent-Tahsildar (CS), Itikyala Mandal submitted a report to the third respondent-Revenue Divisional Officer, Gadwal on 23.02.2015. After receipt of the report of the Tahsildar, a show cause notice was issued to the petitioner on 03.03.2015 and the petitioner submitted his explanation on 10.03.2015.
After receiving explanation, the third respondent passed an order on 24.03.2015 suspending the authorization of the petitioner. Challenging the same, the present writ petition is filed. The learned counsel for the petitioner submits that the impugned order was passed without indicating any period or stating that it is pending enquiry.
Since no enquiry was conducted by the third respondent, this Court deems it fit to direct the third respondent to conduct enquiry in respect of the allegations levelled against the petitioner and complete the same, within a period of 30 days from the date of receipt a copy of this order and pass appropriate final orders thereon by following principles of natural justice and giving opportunity to the petitioner.
With the above directions, the writ petition is disposed of. Miscellaneous Petitions, if any, pending in this writ petition shall
stand closed. No order as to costs.
