Upon hearing both sides, at the admission stage, the following Order is passed:
Having regard to the prima facie accusation contained in the FIR, it is not a fit case to quash the proceedings. Hence, the investigation shall be taken up to unearth the truth or otherwise of the complaint allegations. However, considering the submission of learned counsel for petitioner that the petitioners are not trespassers and petitioner/accused No.1 is Trustee-cum-Archaka and the petitioners/Accused No.2 to 4 are Archakas of Sri Rajarajeswari Temple and the other accused/petitioners are agricultural coolies and they have not committed any theft or caused any injuries to the complainant, the Police of J. Pangulur Police Station, Prakasam District, are directed not to arrest the petitioners/Accused Nos. 1 to 18 during the course of investigation. The petitioners shall cooperate with the investigating agency for smooth completion of investigation. With the above observation, the Criminal Petition is disposed of.
