THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CIVIL REVISION PETITION No. 3353 of 2015 ORDER:

The petitioner herein is plaintiff in O.S.No.245 of 2012 on the file of the Additional Senior Civil Judge, Eluru, West Godavari District. The suit was filed for permanent injunction in respect of suit 'A' and 'B' schedule properties situated in Lingagudem Village, Chintalapudi Mandal, West Godavari District. The trial Court granted temporary injunction in respect of 'A' schedule property in I.A.No.1387 of 2012 and dismissed the application with regard to 'B' schedule property. Challenging the order passed by the trial Court to the extent it went against him, the petitioner preferred C.M.A.No.27 of 2014 before the I Additional District Judge, West Godavari at Eluru, and the learned I Additional District Judge granted temporary injunction, during the pendency of C.M.A.No.27 of 2014, and ultimately, the said C.M.A. was dismissed by order dated 01.06.2015, challenging which, the present civil revision petition is filed.

In view of the orders passed by the trial Court as well as the appellate Court during the pendency of C.M.A.No.27 of 2014, this Court sees that the merits of the matter need not be gone into at this stage, and justice would be served, if the civil revision petition is disposed of with a direction to both the parties to maintain statusquo with regard to 'A' and 'B' schedule properties, till disposal of O.S.No.245 of 2012, and the learned Additional Senior Civil Judge, Eluru, shall dispose of the said suit as expeditiously as possible, but not later than six (6) months from the date of receipt of a copy of the order.

3. The Civil Revision Petition is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending in the civil revision petition shall stand dismissed. There shall be no order as to costs. _______________________________ A.RAMALINGESWARA RAO, J
