HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18847 OF 2016 ORDER:
The case of the petitioner is that he is the absolute owner of the agriculture land in Sy.No.101/E, 102/E, 101/EE, 101/AA and 102/A, admeasuring Ac.1.16 guntas at Balanagar Village and Mandal, Mahabubnagar District having purchased the same by way of registered sale deed. The petitioner's name also got mutated in the revenue records based upon the sale deed and he is in possession and enjoyment of the said land. While so, when the respondents 3 to 6 tried to interfere with the possession and enjoyment of the petitioner over the above land, the petitioner filed OS No.96/2015 seeking perpetual injunction wherein the respondents 3 to 6 contended that Late Mangali Narayana is the Protected Tenant over the subject land and they are the legal heirs of the said Protected tenant.
On verification of the revenue records, it is revealed that Mangali Narayana was being Protected tenant has orally surrendered his PT rights even before preparation of Khasra Pahani for the year 1954-1955 and accordingly in the khasra Pahani of the aforesaid land, the names of the original owners are being shown as pattadars and possessors. But, the Revenue Authorities, without considering the same are continuing to record name of the Mangali Narayana as Protected Tenant by ignoring the Khasra Pahani. As such, the petitioner submitted application before the 2nd respondent on 06.11.2015 to delete the name of the Mangali Narayana as protected tenant of the aforesaid land based upon his oral surrender prior to preparation of Khasra Pahani.

Heard learned counsel for the petitioner.
Learned Assistant Government Pleader for Revenue produced written instructions dated 14.06.2016 wherein it is stated that the petitioner's case is taken up for enquiry and notices have been issued and the case is posted for hearing on 25.06.2016. In view of the above, the competent authority is directed to dispose of the application of the petitioner dated 06.11.2015 in accordance with law after issuing notices to the affected parties. With the above direction, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
