HON'BLE SRI JUSTICE A.RAJASHEKER REDDY W.P.No.22914 of 2016 ORDER:
The petitioner herein earlier filed W.P.No.16059 of 2016 with the same prayer as prayed in the instant writ petition and this Court disposed of the Writ Petition by order, dated 06-052016 as follows : "In that view of the matter, it is directed that status quo obtaining as on today shall be maintained by both parties only till 10-05-2016 to enable the petitioner to re-present the suit and the interlocutory application, so as to seek the relief, in which event, the Civil Court to pass orders in accordance with law uninfluenced by the 'status quo' order granted herein".
Now, the learned counsel for the petitioner submits that he has already filed civil suit.
The learned Assistant Government Pleader for Revenue submits that the prayer in the W.P.No.16059 of 2016 and the prayer in the instant writ petition are same. A perusal of the prayer in the present writ petition and the prayer in W.P.No.16059 of 2016 goes to show that they are one and the same. This Court passed order in W.P.No.16059 of 2016 on 06-05-2016 and the same has become final. The Writ Petitioner cannot file the present writ petition for the same relief once again. Hence, I see no reason to entertain the instant writ petition.
Accordingly, the Writ Petition is dismissed. No order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
