HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 22100 of 2016 Order:

The petitioner was appointed as Anganwadi Worker in the year 2002 in respect of Lingaraopalem village, Yedlapadu Mandal, Guntur District. When there are some allegations, the petitioner submitted her explanation, but without considering the explanation, basing on the report of the third respondent the petitioner was suspended from service by an order dated 04.12.2014. When the departmental proceedings were not concluded, the present Writ Petition was filed. 2.

Learned Government Pleader took time for getting instructions and on instructions he submits that the petitioner was placed under suspension under a final order dated 04.12.2014 on the basis of the reply furnished by the petitioner to the memo dated 19.09.2014. When a note was put up before the District Collector to appoint an Enquiry Officer to enquire into the allegations the District Collector, Guntur, approved the note orders to conduct enquiry by the respective Tahsildar i.e., Tahsildar, Edlapadu, Guntur District. The Enquiry Officer has not submitted any enquiry report so far.

In view of the pendency of the enquiry, this Court is not inclined to interfere with the order of suspension. But, however, directs the third respondent to complete the enquiry initiated against the petitioner through the enquiry officer within a period of three (3) months from the date of receipt of a copy of this order and pass appropriate orders in accordance with law.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
