HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.32301 of 2018 ORDER:

This Writ Petition is filed, under Article 226 of the Constitution of India, seeking the following relief. "to issue a writ of mandamus or any other appropriate writ or direction declaring the action of the Respondents No. 3 to 5 in opening the Rowdy sheet No 486 against the petitioner as illegal arbitrary violative of AP Police Standing Order 742 and contrary to the Principles of natural justice and consequently set aside the same by directing the respondents to close the Rowdy Sheet No 486 against the petitioner pending on the file of the 5th Respondent by duly considering the representations dated 20.08.2018 in the interest of justice."

Heard learned counsel for the petitioner, learned Assistant Government Pleader for Home and perused the record. 3.

Learned Assistant Government Pleader for Home produced written instructions, wherein it was mentioned that the petitioner was involved in four criminal cases for different offences and in three cases he was acquitted and as on today one case is pending against him. It is stated that the petitioner is a habitual offender involved in many cases. The petitioner made representation to the Station House Officer, Puttur Police Station, Chittoor District on 20.08.2018 to close the Rowdy Sheet. As no action was taken, the present writ petition is filed.

Learned counsel for the petitioner submits that in similar circumstances, this Court disposed of W.P.No.23312 of 2018 by its order dated 09.07.2018.

In view of the same, for the reasons alike in the said order, this Writ Petition is also disposed of directing the competent authority to consider the representation, dated 20.08.2018, stated to have been filed by the petitioner and take appropriate action in accordance with law, within a period of (4) weeks from the date of receipt of a copy of this order.
