THE HON'BLE THE ACTING CHIEF JUSTICE DILIP B.BHOSALE & THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT APPEAL No.573 of 2016 PC: (Per Hon'ble the Acting Chief Justice Dilip B.Bhosale) Heard Mr. T. Durga Reddy, learned Government Pleader for Assignment (TG) for appellants and Mr. C. Hanumantha Rao, learned counsel for respondents.
2. Learned counsel for parties have agreed for the order that we propose to pass and have fairly stated that we need not record any reasons for the same. Hence, we dispose of the appeal by the following order: 1.
Order dated 16.06.2016, impugned in the present appeal, is set aside.
2. So far as order dated 03.06.2016 is concerned, in our opinion, it was operating till 13.06.2016, on which date the counter affidavit was filed by the State Government and hence, there is no need to pass any order in respect thereof.
3. The learned single Judge is requested to hear and decide WP.No.7753 of 2015 expeditiously and if that is not possible, WPMP.No.10256 of 2015 with WVMP.No.2068 of 2016 at least may be decided on merits expeditiously. It is made clear that this Court has not examined merits of the case and/or rights of the parties in respect of the subject land. All contentions on merits are kept open.
The writ appeal is disposed of. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
