THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.38960 of 2016 ORDER:

Heard Sri N.Subba Rao for petitioner and Government Pleader (Revenue) for respondents.

The petitioner prays for Mandamus declaring the action of respondents in demolishing the structures raised by him in an extent of Ac.0-59 cents in Sy.Nos.93 and 94 of Piler Village and Mandal, Chittoor District, without recourse to law, as illegal, arbitrary and unconstitutional.

At request of learned counsel representing respondents 1 to 3, the writ petition was adjourned.

The Assistant Government Pleader (Revenue) seeks the leave of the Court to place on record the written instructions, dated 21-11-2016 received from 3rd respondent. The instructions read thus :- " In this connection it is submitted that the SubCollector, Madanapalle, Chittoor District has instructed the Executive Engineer (R&B), National Highways Division, Chittoor has informed that the Government of India, New Delhi, has issued Gazette in No.1738 dated 13-7-2016 in 3(a) Notification for appointing the Sub-Collector, Madanapale as competent Authority for construction of Railway Over Bridge (ROB) at Km.56/ 300 at Piler town of Chittoor-Kurnool Road (NH-18) and also informed that the land has to be surveyed for preparation of

Draft 3(A) & 3(D) Notifications for land acquisition for the work and requested to depute surveyor for land survey and to submit the 3(A) & 3(D) proposals. In this connection it is submitted that after survey of land necessary Land Acquisition Proceedings will be issued under Land Ac quisition Act.

Therefore, the writ petition is devoid of merits and may be dismissed at the stage of admission."
