THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No.1640 of 2015 ORDER:

This contempt case is filed alleging the willful disobedience of the order dated 04.03.2015 passed by this Court in W.P.No.5403 of 2015.

By an order dated 04.03.2015 this Court gave liberty to the petitioner to submit an application before the Tahasildar in the prescribed Form VI-A for the purpose of obtaining Pattadar Pass Books.

Respondent filed a counter affidavit stating that in terms of the orders of this Court, petitioner had submitted an application on 23.04.2015 and the same was processed. During the course of inquiry it came to light that the property originally belongs to one Rayala Appayya, who in turn sold the same to one Gaddam Venkateswarlu. However, it appears that the wife of Rayala Appayya sold the very same property in favour of one Vankayalapati Kotaiah. Subsequently, Gaddam Venkateswarlu sold the property to the petitioner. Inasmuch as, there are rival claims and there being disputed questions of fact, a final order dated 23.09.2015 in Rc.No.362/2015/A was made and as the petitioner refused to receive the said order, the same was dispatched through Registered Post with Acknowledgment due on 24.09.2015.

Though the counter affidavit was served on the petitioner on 10.02.2016, no reply affidavit has been filed denying the contents thereof.

Having considered the respective submissions, though there is a delay of two months in making the order, considering the nature of work involved the delay is condoned. Inasmuch as, the orders have been made by the respondent, there being substantial compliance of the orders of this Court, this Contempt Case is closed with an observation that the petitioner is at liberty to avail appropriate remedies as available if he is otherwise aggrieved by the orders made by the respondent in Rc.No.362/2015/A, dated 23.09.2015.

Miscellaneous Petitions pending, if any, in this Contempt Case shall stand closed. No costs.
