THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.9620 OF 2015 ORDER :

This writ petition is filed seeking writ of mandamus declaring the action of the 1st respondent in issuing notification for public auction in RC No.C1/3149/2015, dt.21.03.2015 so far it relates to the shop with D.No.11-24-86, situated in Bhavannarayana Street, Vijayawada belonging to the 1st respondent which is under the petitioner deemed renewal for a period from 01.05.2014 to 30.04.2017 under the deemed provision in AP Charitable and Hindu Religious Institutions and Endowments Immovable Properties and other Rights (other than the Agricultural Lands and License Rules) Act, 2003 as illegal and arbitrary and consequently to direct the respondents not to conduct any auction to the leasehold rights for the subject shop. Heard Sri K.Sarvabhouma Rao, learned counsel for the petitioner as well as Smt. K.Lalitha, learned Standing Counsel for the first respondent temple.

This Court, in similar circumstances dismissed writ petition i.e., W.P.No.9502 of 2015 today and the same is not disputed by both the learned counsel.

For the reasons alike in the order in W.P.No.9502 of 2015, this writ petition is dismissed in terms of the above said order. However, if petitioner made any representation, the same shall be considered and disposed of in accordance with law. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any pending in the writ petition, shall stand closed.
