ORDER

This application is filed to withdraw F.C.OP.No.779 of 2011 from Additional Metropolitan Sessions Judge for Trial of JHBBCcum-Additional Family Court at Nampally, Hyderabad to Family Court, Secunderabad or any other competent Court. As per the affidavit filed in support of the petition, the ground for transfer is that petitioner herein is a judicial officer and only regular Family Courts like Secunderabad Family Court are working on Second Saturday and Sundays, in order to facilitate working spouses and as the Additional Family Court has no such facility, the petitioner is compelled to apply for leave and on some occasions, even though she appeared matter was not taken-up. For these reasons, she prayed for transfer of case F.C.OP.No.779 of 2011 from Additional Family Court, Nampally to Family Court, Secunderabad.

Advocate for respondent submitted that respondent has no objection for transfer but some time may be fixed for speedy disposal of the case, as it was already pending since 2011. Considering submissions of both sides, without going into merits and demerits of the case, F.C.OP.No.779 of 2011 is withdrawn from Additional Metropolitan Sessions Judge for Trial of JHBBC-cum-Additional Family Court at Nampally, Hyderabad and transferred to Family Court, Secunderabad for disposal in accordance with law. The Judge, Family Court, Secunderabad shall dispose of the case within two months from the date of receipt of records and petitioner is at liberty to make a request to the Presiding Officer to post Family Court O.P. on Second Saturday and Sunday to enable the petitioner's appearance.

Accordingly, the Transfer CMP is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand dismissed.
