THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.15055 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents.

2. The petitioner claims that he is the owner of lands to an extent of Ac. 14.27 guntas and Ac. 2.15 guntas respectively in Survey Nos.468 and 469 of Narayanraopet Village, Siddipet Mandal, Medak District, having purchased the same under registered sale deeds. The petitioner's name was mutated in the revenue records. While so, respondents 3 to 5 visited the petitioner's lands for the purpose of laying the road and in fact, the laying was commenced on 19.05.2015. Though at the protest of the petitioner it was stopped for some time, it was resumed later. It is the further case of the petitioner that an extent of Ac. 8.09 guntas in Survey No.474 was earlier donated for the construction of Sri Bugga Rajeswara Swamy Temple in the Village. If the road is allowed to be laid in the middle of the lands, the lands would become useless. It is the case of the petitioner that no notice was issued to him before laying the road.

3. In the circumstances, it is directed that the respondents 2 to 5 shall follow due process of law if they want any portion of the private patta lands of the petitioner for any public purpose. The respondents shall not interfere with the possession of the petitioner's land without following due process of law.

4. The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. __________________________ (A.RAMALINGESWARA RAO, J)
