Boddu Bhaktavathsala Naidu, v. Mr. B. Narasimhulu,
HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CONTEMPT CASE No. 2414 of 2015 ORDER:
The grievance of the contempt petitioner is that in terms of compromise decree passed in the Second Appeal on 3.2.2005, respondent No.5 is not affecting the division of properties and hence, the present Contempt Case.
If that is the case of the petitioner, he has an alternative and efficacious remedy of putting in execution of compromise decree before the trial Court. Therefore, the petitioner can pursue his legal remedy.
Accordingly, this Contempt Case is closed with the above observation .
As a sequel, miscellaneous applications pending if any, shall stand closed.
