THE HON'BLE SRI JUSTICE A.V. SESHA SAI APPEAL SUIT No.523 of 2010 And A.S.M.P.No.1689 of 2016 COMMON JUDGMENT:

A.S.M.P.No.1689 of is filed by the appellant/defendant under Section 151 of C.P.C., seeking permission of this Court to withdraw A.S.No.523 of 2010. Reiterating the contents of the affidavit filed in support of ASMP No.1689 of 2016 it is stated by learned counsel for the appellant that pending appeal all the parties have compromised the matter at the intervention of the elders and O.S.No.309 of 2012 was referred to Lok Adalath and terms of compromise were also recorded and an award was also passed.

In view of the above, ASMP No.1689 of 2016 is allowed, permitting the appellant to withdraw A.S.No.523 of 2010 and consequently, A.S.No.523 of 2010 is dismissed as withdrawn. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Appeal Suit shall stand closed.
