HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.31841 OF 2016 ORDER:
Sri C.Prakash Reddy, learned counsel for the petitioner, learned counsel for the unofficial respondents and learned Assistant Government Pleader for Revenue submits that the writ petition can be disposed of with a direction to consider the representation of the petitioner to the extent of conducting survey, in respect of the subject land to an extent of 0.10 cents in Survey No.203/2, situated at Nagarajupalle, Kadapa, YSR Kadapa District.
Learned Assistant Government Pleader for Revenue submits that in pursuance to the application of the petitioner, the Town Surveyor, Municipal Corporation, Kadapa, has issued notice dated 19.12.2016 to the petitioner and as well 5th respondent, fixing the date to be present in connection with the disputed land. In pursuance of the said notice petitioner's husband and the counsel for the 5th respondent have attended on 07.01.2017 and the counsel for the 5th respondent has handed over the statement of 5th respondent. Learned counsel for the petitioner submits that the notices were issued after filing of this writ petition. Since the Town Surveyor has already issued notice, the writ petition is disposed of directing the Town Surveyor,
Municipal Corporation, Kadapa, who has issued notice dated 19.12.2016, to conduct survey after issuing notices to the petitioner as well as 5th respondent, within a period of six weeks from the date of receipt of a copy of this order. Accordingly, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending, shall stand closed.
