HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.21911 OF 2017 ORDER:

Heard the learned counsel for the petitioner and the learned Govt.Pleader for Fisheries representing respondents 1 and 2, before ordering notice to the unofficial 3rd respondent and perused the Writ Petition prayer, supporting affidavit and also the so called representation of the petitioner addressed to the 2nd respondent dt.07.06.2017 acknowledged on 08.06.2017. The very prayer of the Writ Petition reads as:- " To issue writ or direction preferably Writ of Mandamus declaring the inaction of the respondent Nos. 2 and 3 in considering the representation dated 18.06.2017 submitted for readmission of the petitioner into fishermen cooperative society, Mathkeopalle (Namavaram), Chinthakani Mandal of Khammam District as per revised viability norms as contemplated under G.O.Ms.No.

6 Animal Husbandry, Diary Development, Fisheries(V&F) Department, dt.24.03.2016 as illegal, arbitrary, and violative of principles of natural justice and consequently direct the respondent Nos.

It is the submission in support of the prayer from the affidavit averments that his representation is not so far disposed of by considering the same to join as a Member of the 3rd respondentSociety. Having regard to the above, the Writ Petition is disposed of directing the 2nd respondent to consider any entitlement of the petitioner on own merits of said representation of the petitioner to

be joined if at all as a Member of the 3rd respondent-Society as per due process of law, within four weeks from today. As a sequel, miscellaneous petitions if any pending in this Writ Petition shall stand closed.
