HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CIVIL REVISION PETITION No.5335 OF 2018 O R D E R :

This Civil Revision Petition filed against the docket order dated 20.07.2018 in EP.No.23/2015 in OS.No.93/2011 on the file of Principal Junior Civil Judge, Tadepalligudem, wherein arrest warrant was issued against the petitioner/J.Dr.

Heard learned counsel for the petitioner.

Admittedly, petitioner has appeared through advocate in the EP and thereafter he did not file counter, and exparte order dated 09.11.2015 was passed and he filed EA.14 of 2017 in EP.No.23/2015 to set aside the exparte order which was dismissed on 23.03.2017 holding that no bonafide reason is alleged by petitioner for his non-appearance on 09.11.2015 and it is also stated that the petition is filed with enormous delay without filing application under Section 5 of the Limitation Act. The said order is not challenged, as such, it became final. As a result when petitioner was disobeying the injunction decree, present impugned order is passed. In view of the above facts and circumstances, I do not see any infirmity in the impugned order passed by the executing Court.

Accordingly, the Civil Revision Petition is dismissed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _______________________________ A.RAJASHEKER REDDY, J 18.09.2018 t k.
