This Writ Petition is filed to declare the action of the respondents 2 and 3 in permitting the fourth respondent to open the shop for sale of Indian made foreign liquor and foreign liquor in the premises bearing Door No.20/341/AE-35, 27th Ward of Gunthakal Municipality, vide license No.57/2014-15/B, dated 20.12.2014 as illegal and arbitrary. When the matter is taken up for hearing today, it is represented by the learned counsel for the petitioner that nothing survives for adjudication in the Writ Petition and the matter has become infructuous. Recording the said submission, the Writ Petition is dismissed as infructuous. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
