HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 32282 of 2018 ORDER:

1) The present Writ Petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents particularly 4th respondent in issuing Form 1 and 2 notices vide Rc.No.87/ 18 dated 13.07.2018, proposing to cancel the assignment granted in favour of the original owner and to evict the petitioners from their lands in Sy.No.64/ 2 to an extent of Ac.0.03 cents, Sy.No.64/ 2 to an extent of Ac.0.03 cents, Sy.No.64/ 2 to an extent of Ac.0.03 cents and Sy.No.64/ 2 to an extent of Ac.0.03 cents situated at KG Kandriga Village, Kondepi Mandal, Prakasam District, without considering the explanation dated 08.08.2018, as illegal, arbitrary and violative of principles of natural justice.

2) At the time when the matter is taken up for hearing, it is brought to the notice by the Government Pleader for Revenue (AP) that pursuant to the notice issued under Form 1 and 2, explanations came to be submitted on 08.08.2018 and thereafter an order of resumption of lands came to be passed on 14.08.2018. 3) Learned counsel for the petitioners would submit that the petitioners are not aware of the same and even the copy of the order is not communicated to them.

4) Having regard to the fact that final order came to be passed on 14.08.2018, the respondents shall communicate a copy of the order to the petitioners, within a week from the date of receipt of a copy of the order, in which event, the petitioners can challenge the same, if so advised, in accordance with law. 5) With the above direction, the writ petition is disposed of.
