HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.13966 of 2016 ORDER:
The instant criminal petition is filed under Section 482 of the Code of Criminal Procedure, 1973, to quash the proceedings in Crime No.277 of 2016 of Mancherial Police Station, Adilabad District, which was registered for the offences punishable under Sections 420, 447, 427, 506 read with Section 34 I.P.C.

Petitioner Nos.1 to 3 herein are arraigned as accused Nos.1 to 3 in the said crime and alleged to have committed the aforesaid offences.

Heard Sri P.Lakshma Reddy, learned counsel for the petitioners, and the Public Prosecutor for respondent No.1-State. 4.
Learned counsel for the petitioners would represent that the de facto complainant, who is respondent No.2 herein, was not in possession of the land which he claims now, located in Sy.No.324/A2 to the extent of Acs.4-00 cents, as claimed by him, and, in fact, he would submit that the petitioner No.1 is cultivating the extent of Acs.2-00 cents belonging to petitioner No.3, but not the land belonging to the de facto complainant.

Though, overt acts are not finding place as to the assault, still, in view of the stage at which the proceedings stand, the
ASN, J CRL.P.No_13966_2016 investigation shall go on, but, however, the petitioners herein shall not be arrested, but the petitioners are directed to present themselves before the investigating officer concerned, as and when directed, for the purpose of interrogation and shall cooperate with the investigating agency.

Accordingly, the instant Criminal Petition is disposed of. 7.
