ORDER:

This Writ Petition is filed for a Mandamus to declare the inaction of respondent Nos.2 and 3, in responding to the petitioner's representations, dated 23.12.2015 and 30.12.2015, against respondent No.6, as

illegal and arbitrary.

The substance of the petitioner's grievance against respondent No.6 is three fold, viz., (1) that respondent No.6 has installed A.C. plant in the parking area; (2) that he is using the club house for commercial purpose; and

(3) that he is trying to remove the terrace garden. As regards grievance No.3 supra, in my opinion, respondent Nos.2 and 3 are not concerned with the alleged act of respondent No.6.

However, as regards grievance Nos.1 and 2 supra, Mr. P.Kesava Rao, learned Standing Counsel for the Greater Hyderabad Municipal Corporation (GHMC), appearing for respondent Nos.2 and 3, on instructions, submitted that the petitioner's representations were considered and on inspection by the officials of the GHMC, the same were found incorrect. He has, however, submitted that respondent No.3 will send a suitable communication to the petitioner on the above aspects.

In the light of the above submissions of the learned Standing Counsel, the Writ Petition is disposed of with the direction to respondent No.3 to send an endorsement on grievance Nos.1 and 2, referred to above, based on the inspection of the officials of the GHMC, within two weeks from the date of receipt of a copy of this order. If the petitioner feels aggrieved by such communication, it shall be free to avail appropriate remedy before competent forum.

As a sequel to disposal of the Writ Petition, WPMP.No.3139 of 2016 shall stand disposed of as infructuous.
