CRLPMP.( SR) .No.3 2 0 1 7 of 2 0 1 7 :

This petition is filed by the petitioner/ respondent No.2 in CrlP.No.5317 of 2013 seeking for recording of the compromise entered into between the parties as per the Memorandum of Understanding dated 25.07.2017.

Office took an objection stating that an affidavit and a Joint Memo also need to be filed along with the petition. The counsel for the petitioner submits that a Memorandum of Understanding was entered into between the parties and the same would suffice as a joint memo; that the parties are residing in U.S.; that earlier before the Family Court, the parties presented the Memorandum of Understanding and compromise was recorded in all the cases; so also the quash petitions filed before this court viz., CrlP.No.6598 of 2017 and CrlP.No.5325 of 2017 are allowed and the proceedings therein are quashed considering the Memorandum of Understanding.

Hence, there will be not be any hurdle to rely on the Memorandum of Understanding and the office objection is accordingly overruled.

Hence, the memorandum of understanding in taken on record recording the compromise arrived at by the parties. The petition is accordingly allowed.

CRLP.No.5 3 1 7 of 2 0 1 3:

In view of the above, the criminal petition is allowed and the proceedings against the petitioners in DVC No.82 of 2013 on the file of the Court of IV Metropolitan Magistrate, Erramanzil, Hyderabad are hereby quashed.

As a sequel, the miscellaneous applications, if any pending, shall stand closed.
