HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.34258 of 2015 ORDER:

Heard Sri N.A.Ramachandra Murthy, learned counsel appearing for the petitioner and Sri Bathula Raj Kiran, learned standing counsel for the respondents-LIC of India.

2. The petitioner is working as Assistant in the LIC of India, Chirala branch. On promotion to the post of Higher Grade Assistant, the petitioner was transferred from Chirala to Markapur vide impugned proceedings dated 02.03.2015. The petitioner is a physically challenged person. The petitioner challenged the said transfer in the present writ petition on the ground that in the normal course, a physically challenged person of Grade-C or Grade-D, has to be given posting as far as possible in their native place or at least in their native district, subject to administrative constraints. Reliance is placed by the learned counsel appearing for the petitioner on the Office Memo dated 10.05.1990 and also Circular dated 19.10.2012 issued by the respondents with regard to transfers and postings of physically challenged persons. Basing on the above mentioned two documents, the petitioner made a representation dated 27.07.2015 to the respondents to consider his request to retain him in Chirala on promotion in the existing vacancy.

Having regard to the afore mentioned facts and circumstances, without going in to the merits of the case, the respondents are directed to consider the representation dated 27.07.2015 submitted by the petitioner and pass appropriate orders thereon within a period of eight (8) weeks from the date of receipt of a copy of this order.

4. The writ petition is accordingly disposed of. Miscellaneous

petitions, if any, pending in this writ petition, shall stand closed. No order as to costs.
