HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.9595 of 2018 ORDER :

The petitioner, who is accused filed this petition under Sections 437 and 439 Cr.P.C. seeking enlargement on bail in Crime No.529 of 2018, dated 12.08.2018, on the file of PetBasheerabad Police Station, Cyberabad District, registered for the offences punishable under Section 304-B I.P.C. 2.

Heard the learned counsel for the petitioner and the learned Public Prosecutor representing the State in opposing the bail and perused the FIR, remand report, bail application averments, Case Diary and the earlier dismissal order of the bail application in Crl.MP.No.3540 of 2018 on 31.08.2018 passed by the IV Additional Metropolitan Sessions Judge, L.B.Nagar, Ranga Reddy District.

A perusal of the Case Diary shows from the very F.I.R. earlier even, there were threats by the accused to do away the deceased, who is his wife. It is, within five years after the marriage, the deceased met with an unnatural death. From the report of the de facto complainant, who is sister of the deceased, there is a suspicion of suicide or otherwise. There is a prima facie accusation, from perusal of the Case Diary. The fact that the petitioner is in judicial custody since

14.08.2018 itself is not a ground to grant bail. Though, it is the contention of the learned counsel for the petitioner that the investigation is completed, from what the learned Public Prosecutor submits that no charge sheet is filed. 4.

Accordingly, the Criminal Petition is dismissed. 5.

Miscellaneous petitions pending, if any, shall stand closed.
