THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.25240 OF 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue a Writ order or direction, more particularly one in the nature of Writ of mandamus, declaring the action of the 4th respondent in interfering with the construction activities of the writ petitioner in house bearing No. 12/441 in plot No.221 of Kalugotla Road, Harijana Colony, Yemmiganur Village and Mandal, Kurnool District at the behest of the 5th respondent without any legal rights is illegal, arbitrary and violation of principles of natural justice and consequently direct the 4th respondent not to interfere into the civil disputes at the behest of 5th respondent by obstructing the construction activities of the writ petitioner, and pass such other order or orders may deem fit and proper in the circumstances of the case."

When the matter is called today, written instructions dated 19.08.2015, furnished by the Sub Inspector of Police, Yemmiganur Town Police Station, Kurnool District, have been placed on record by the learned Government Pleader for Home and the said instructions read as under:

"It is respectfully submitted that one P. Suseela who is the petitioner herein approached Yemmiganur Town police on 18.07.2015 and gave an oral complaint against one Praveen Kumar / 5th respondent and others stating that they have obstructed while constructing house and requested to do justice.

Basing on the same the respondent police sent a requisition to Tahsildhar of Yemmiganur town with a request to visit the site personally and redress the issue. On that the Tahsildhr of Yemmiganur visited the above said site and even though showing the boundaries, the petitioner could not satisfy and approached the Revenue

Divisional Officer of Adoni.

It is further submitted that in this connection to day i.e., 19.08.2015 the said site was being surveyed amidst the police protection in the presence of Revenue Divisional Officer with Government Surveyor.

It is further submitted that the respondent police are never interfere with the petitioners civil disputes, and did not bow to any pressures, the survey was also conducted as per the request of the petitioner, hence the allegations made against the respondent police to interfere into the civil disputes is far from truth, hence denied."

3. On noticing the said written instructions, learned counsel for the petitioner requested this court to dispose of the writ petition by recording the said written instructions.

4. In view of the above, writ petition stands disposed of, by recording the written instructions dated 19.08.2015, furnished by the Sub Inspector of Police, Yemmiganur Town Police Station, Kurnool District.
