HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.6491 OF 2016 ORDER:
The petitioner, who is A.1 in Crime No.58 of 2016 of Afzalgunj Police Station, Hyderabad, filed this criminal petition under Section 438 of Cr.P.C., seeking release in the event of his arrest in connection with the above crime registered for the offence punishable under Section 420 IPC r/w. 34 IPC.
The case of the prosecution is that on 07.02.2016 at 18-25 hours, on a report received from Sri K. Shiva Shankar, HC-8341 stating that while he along with another constable was performing patrolling duties in MGBS, Hyderabad, as per the instructions of the Inspector of Police, Afzalgunj Police Station, Hyderabad, noticed a person moving under suspicious circumstances, on seeing the police, he started running from the spot towards entry way of MGBS, Hyderabad. They chased and apprehended him. On checking his bag, they found passports, Laptop and Cell phones, pen drive and stamps. On enquiry, he revealed his name, but could not give suitable answers about the things carried by him. Basing on these allegations, the above crime came to be registered.
Learned counsel for the petitioner submits that the allegations leveled against the petitioner are all false and invented for the purpose of this case.
On the other hand, the learned Public Prosecutor opposed the said application.
Having regard to the nature of the allegations made in the report, I am not inclined to consider the request of the petitioner/A.1 for grant of anticipatory bail. However, the petitioner may surrender before the Police Station concerned and move an appropriate application before the Court concerned seeking bail, in which event, the same shall be dealt with on the same day in accordance with law.
Subject to the above directions, the Criminal Petition is dismissed.
