HON'BLE SRI JUSTICE C.PRAVEEN KUMAR W.P. No. 32750 of 2018 ORDER:

The present writ petition came to be filed seeking the following relief:

" To declare the action of the respondents in not considering the petitioner's representation dated 21.05.2018 to grant of Patta Passbooks and Title deeds in Sy.No. 572 admeasuring Ac.2-87 cents of Mamillapalle, Chinthakommadinne, YSR District to the petitioner by canceling of Pattadar Passbooks issued to third parties is being as illegal, arbitrary and violative of Article 14 and 300-A of the Constitution of India and contrary to the provisions of the A.P. Rights in Land and Pattadar Pass Books Act, 1971 and consequently direct the respondents to consider the petitioner's representation dated 21.05.2018 to grant of Patta Passbooks and Title deeds in Sy.No.572 admeasuring Ac.2-87 cents of Mamillapalle, Chinthakommadinne, YSR District to the petitioner by canceling the Pattadar Passbooks issued to third parties in accordance with provisions of the A.P. Rights in Land and Pattadar Passbooks Act, 1971."

At the time when the matter is taken up, learned counsel for the petitioner would submit that the petitioner filed an appeal

before the Revenue Divisional Officer, and a direction may be issued to the said authority to dispose of the said appeal. 3.

At this stage, the learned Government Pleader would submit that if the said appeal is maintainable and if the relief sought for therein can be granted by the Revenue Divisional Officer, the same would be disposed of, in accordance with law. 4.

Recording the statement made by the learned Government Pleader, the writ petition is disposed of at the admission stage with consent, directing the concerned Revenue Divisional Officer to deal with the appeal filed by the petitioner in No. H/ 962/ 18, in accordance with law, keeping in view the maintainability of the appeal, and the relief sought, and then pass orders, after hearing all concerned, including the petitioner, as early as possible, preferably, within a period of three to six months from the date of receipt of a copy of this order.
