HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE WRIT PETITION No. 17088 of 2010 ORDER:

Learned counsel appearing for the parties state that this writ petition is squarely covered. A copy of the order, dated 15.11.2012, passed by this Court in W.P.No.17998 of 2012 is placed on record.

For the reasons alike as were mentioned in the said order, this writ petition is disposed of directing that in case the seigniorage fee on the sand utilized by the petitioner company in the works executed by it was deducted from its bills and proof thereof is filed before the Assistant Director of Mines and Geology concerned, no penalty shall be levied. Consequently, miscellaneous petitions, if any, also stand disposed of. There shall be no order as to costs.
