HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 19113 of 2016 ORDER:
Heard learned counsel for the petitioner and Government Pleader for Home. With the consent of both the parties, the present writ petition being taken up for disposal at the admission stage itself.
The present Writ Petition came to filed seeking issuance of a Writ of Mandamus declaring the action of the third respondent in not filing the charge sheet/final report in Crime No.266 of 2013 of Chilkalguda Police Station, as illegal and arbitrary; and consequently to direct the third respondent to expedite investigation and file final report as early as possible. Learned counsel for the petitioner submits that though the above crime was registered in the month of May, 2013 for the offences punishable under Sections 420, 406 and 120 (B) IPC, no charge sheet/final report is filed till date. Learned Government Pleader for Home submits that the police will take appropriate steps in filing the final report, at the earliest.
In view of the representation made and having regard to the nature of allegations made, the respondent-police shall proceed with the investigation in Crime No.266 of 2013 of Chilkalguda Police Station, Hyderabad City, in accordance with law and file a final report as expeditiously as possible, preferably, within a period of two (02) weeks from the date of receipt of a copy of the
order, if not already filed.
With the above direction, the writ petition is disposed of. No order as to costs.
Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
