Bommala Srinivas v. The State Of Telarigana
THE HON'BLE SRI JUSTICE MUMMINENI SUDHEER KUMAR WRIT PETITION No.44253 OF 2022 ORDER:
This Writ Petition is filed questioning the action of respondent Nos.1 and 2 in not taking the decision pursuant to letter No.G1/4106/2008, dated 16.11.2022 of respondent No.5 addressed to respondent Nos.1 and 2 for allotment of alternate land to the petitioner herein and others, as illegal and arbitrary. 2.
This matter earlier came up on 16.12.2022 and on that day, it was represented by learned Assistant Government Pleader for Land Acquisition that the case of the petitioner is under consideration and sought some more time for getting instructions in the matter.
3.
Today, when the matter is taken up for consideration, learned Assistant Government Pleader for Land Acquisition placed before this Court the written instructions received from respondent No.7 wherein it was stated that the proposals were already submitted to the Government and Chief Commissioner of Land Administration awaiting for further orders in the matter. The relevant portion from the said written instructions reads as under:- "Further, it is respectfully submitted that the District Collector, Ranga Reddy has submitted a report to the District Collector, Hyderabad vide Lr.No.LC1/4106/2008, dated 21-02-2022 stating
::2::
that land in Sy.No.510, Kanakamamidi Village, Moinabad Mandal, Ranga Reddy District is available for allotment of equal value alternate land in favour of (30) land losers/awardees in lieu of their lands aqcuired for establishment of Golf Course at Naya Quila, Quila Mohmmed Nagar (V), Golconda (M), Hyderabad and the same can be allotted as per their willingness subject to payment of land value. Further, the Collector, Ranga Reddy District also informed that an extent of Ac.51.00 Gts. is available in the above Survey Number in scattered bits. Further, it is to submit that the District Collector, Hyderabad has submitted a report dated 28-02-2022 and 02-09-2022 to the CCLA along with the representations of Sri.Kausar Moinuddin, Karwan Assembly Constituency and requested for necessary instructions in the matter and the same is awaited as on date." 4.
In the light of the above, the proposals are pending with respondent Nos.1 and 2 since November, 2022 and it appears no action said to have been taken as on date. The petitioner is deprived of his land long back and neither compensation is paid nor an alternate land is allotted and the proposals submitted to respondent Nos.1 and 2 for allotment of the alternate land, as identified by respondent No.5, is not finalized as on date. This Court does not find any justification for the delay being caused in the matter.
5.
Accordingly, Writ Petition is disposed of directing respondent Nos.1 and 2 to forthwith consider the proposals submitted by respondent No.5 through letter No.G1/4106/2008, dated 16.11.2022 and take decision in the matter as expeditiously as possible at any rate within a period of two months from the date of receipt of a copy of this order.
::3::
As a sequel, miscellaneous petitions, pending if any in this Writ Petition, shall stand closed.
