THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.3466 OF 2017 ORDER:

The Writ Petition is filed under Article 226 of the Constitution of India seeking to issue Writ of Mandamus declaring the action of the 3rd respondent in interfering with the petitioners' family dispute with 4th respondent by calling them to Police Station putting them to mental agony without there being any crime registered as illegal and arbitrary and consequently direct the 3rd respondent not to interfere with the petitioners' family dispute. 2.

It is stated that the 4th respondent lodged a complaint and the same was entered in the records of police, dated 23-11-2016 and an enquiry was conducted in connection with the same. 3rd petitioner, who is the husband of the 4th respondent was asked to attend the Police Station. On 12-01-2017, he came to the Police Station in an inebriated condition and created nuisance. As such, he was referred to the Duty Medical Officer, Osmania General Hospital, Hyderabad, for medical check up. When the police again tried to contact the 3rd petitioner, he refused to co-operate with the police. In stead of co-operating with the police, the petitioners filed the present writ petition.

In view of pendency of complaint of the 4th respondent before the police, no further orders can be passed in the present writ petition except observing that the police during the course of investigation shall do so only in accordance with law and not to harass the petitioners.

Accordingly, the Writ Petition is disposed of. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
