This petition is filed for a writ of Mandamus to declare the order of the 3rd respondent dated 03.08.2017 in Rc.No.350/2017/B2, suspending the license of the petitioner to carry on the business, by exercising powers under Section 34(a) of the A.P.Excise Act, as arbitrary and illegal and for a consequential direction to set aside the said order. Learned counsel for the petitioner submits that in similar circumstances this Court disposed of WP.No.24498 of 2017 and batch, dated 25.07.2017, and the same is not disputed by the learned Assistant Government Pleader for Prohibition and Excise.
In view of the same, this Writ Petition is disposed of in terms of the order dated 25.07.2017, passed by this Court in WP.No.24498/2017 and batch directing the petitioner to submit explanation to the show-cause notice within a period of one week from today and thereafter, it is open for the respondents to take further action and pass final orders after affording opportunity to the petitioner without being influenced by any of the observations made in this order. Till passing of final orders, the impugned order shall stand suspended. No order as to costs.
Miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
