THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.13255 of 2016 ORDER:

The petitioners, who are A.1 and A.2 in crime No.173 of 2016 of Pileru Police Station, Chittoor District, filed the present application under Section 438 of the Code of the Criminal Procedure (Cr.P.C.), seeking release in the event of their arrest in connection with the above crime registered for the offences punishable under Sections 341, 307 and 506 r/w.34 IPC.

Heard learned counsel for the petitioners as well as the learned Additional Public Prosecutor.

When the matter is taken up for hearing, it was brought to the notice of this Court that Police have filed a memo deleting Section 307 IPC. It is to be noted that except Section 307 IPC, all other offences alleged against the petitioners are bailable in nature. In that view of the matter, petitioners are directed to surrender before the Court below and move an appropriate application seeking bail, in which event, the same shall be considered on such terms as the said Court deems fit and proper.
