HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.1134 of 2017 ORDER:
Heard both sides before admission.
The condition No.3 of Para 9 of the impugned order dated 06.06.2012 in Crl.M.P.No.467 of 2012 in crime No.1/RCO-ACBVJA/2012 i.e., the petitioner shall not leave the jurisdiction of the Court without obtaining permission from the Court is modified to not to leave the country. It is for the reason as held in the expression of this Court in Crl.R.C.No.3186 of 2016 dated 08.02.2017, the Court got right to impose one of the conditions in granting of bail to deposit the passport with it, however the petitioner is entitled whenever he wants to go aboard, from filing an affidavit petition with assurance of return and the period of transit under Section 6(2) of the Indian Passport Act by seeking return of the passport with that permission for the Court to consider.
Subject to the above observations, the criminal petition is disposed of.
Consequently, miscellaneous petitions, if any shall stand closed. No costs.
