HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.13766 of 2015 ORDER:

Heard the learned counsel for petitioner and the learned Standing Counsel for respondent No.4.

2. This Writ Petition was filed challenging the action of respondents 2 to 4 in imposing a condition to deposit Rs.50,00,000/- for issuance of traders license to the petitioner firm to operate trade in Subabul, Eucalyptus and Casuarina a violative of Articles 14, 19(1)(g) and 21 of the Constitution of India.

3. Though the above relief was sought, the main grievance appears to be that instead of taking bank guarantee, the second respondent is insisting the petitioner to deposit a sum of Rs.50,00,000/- in cash. The third respondent already addressed a letter to the second respondent on 16.03.2015 recommending the case of the petitioner to change the security deposit in the shape of demand draft/cheque to bank guarantee and the matter is pending consideration before the second respondent.

4. In the circumstances, without expressing any opinion on the merits of the case, this Court is inclined to dispose of the Writ Petition directing the second respondent to pass appropriate orders on the basis of the recommendation made by the third respondent in letter No.JDM/VJAB-66/2015, dated 16.03.2015, within a period of two weeks from the date of receipt of a copy of this order.

5. The Writ Petition is, accordingly, disposed of. No order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. _______________________________
