HON'BLE SRI JUSTICE SANJAY KUMAR AND HON'BLE Dr. JUSTICE SHAMEEM AKTHER WRIT PETITION No.29481 OF 2017 ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) The petitioner seeks a writ of habeas corpus declaring the action of the respondents in not producing his wife, Sunkya Pooja, who is being held captive by her uncle, the 6th respondent, as illegal and to direct the respondents to forthwith produce her before this Court. Today, the alleged detenu, Sunkya Pooja, appeared in person before us. We interacted with her in camera and she stated in categorical terms that she is not being held captive. She said that she was staying with her parents and that the 5th respondent is her father. She further confirmed that she was voluntarily staying with her parents and that she was not being held against her will.

We therefore find no indication of any illegal detention of Sunkya Pooja warranting issuance of a writ of habeas corpus. The writ petition is accordingly dismissed.

However, this order shall not preclude the parties from availing appropriate remedies in accordance with law.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
