HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.12306 of 2013 ORDER:

This writ petition is filed to declare the inaction of respondent Nos.2 to 4 in preventing respondent No.5 in raising building in the open place earmarked for park of the colony as illegal and arbitrary. Heard the learned counsel for the petitioner and the learned Standing Counsel for the 3rd respondent.

Counter affidavit has been filed by the 3rd respondent stating that the open space in the layout belongs to the municipality; on 28.3.2013, the municipality received a telephonic message stating that the 5th respondent was digging a bore well in the open site and hence notice was issued to the 5th respondent on 14.3.2013 and directed him not to execute any further work in the open space.

Having regard to the submissions made in the counter affidavit filed by the 3rd respondent and as the 5th respondent was directed not to make any construction in the approved layout space, no further orders are necessary in the writ petition.
