HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.28318 of 2015 ORDER:

Heard Sri A. Jagan, learned counsel appearing for the petitioner and Sri B. Mayur Reddy, learned standing counsel for the respondents-Corporation.

2. The petitioner was initially appointed as Conductor in the Corporation in the year 1985 on daily wage basis and his services were regularised with effect from 22.07.1986. He was promoted to the post of Junior Assistant (Finance) in the month of July, 2009. While he was working as such, he was placed under suspension vide proceedings dated 27.05.2015 levelling certain charges against him. Feeling aggrieved by the order of suspension, he filed WP No.16311 of 2015 and this court by order dated 16.06.2015 in WP MP No.21195 of 2015, granted interim suspension of the suspension order. In pursuance thereof, he was reinstated into services and now he is working as Junior Assistant. The grievance of the petitioner is that, recently some of his juniors were promoted as Senior Assistants, but his case was not considered for promotion, though the suspension order was suspended by this Court and he was reinstated into service.

On the other hand, the learned standing counsel appearing for the Corporation, would submit that an enquiry was initiated into the charges levelled against the petitioner and others and the same is in progress and therefore, merely because, the suspension order was suspended, the petitioner cannot claim the promotion to the post of Senior Assistant as a matter of right. Learned counsel appearing for the petitioner would submit that the petitioner submitted a representation dated 03.08.2015 to the respondents to consider his case for promotion in view of his reinstatement into service and the same is pending.

Under the above circumstances, without going into the merits of the case, the 2nd respondent is directed to consider the representation dated 03.08.2015 submitted by the petitioner, and pass appropriate orders thereon, in accordance with the Regulations of the Corporation, within a period of eight (8) weeks from the date of receipt of a copy of this order.

5. The writ petition is accordingly disposed of. Miscellaneous petitions, if any, in this writ petition, shall stand closed. No order as to costs.
