Alleging violation of the orders of this Court dated 21.03.2017 in W.P.No.36280 of 2016 the present Contempt Case is filed under Sections 10 and 12 of the Contempt of Courts Act, 1971. 2.

Today when the matter is taken up, a letter bearing Rc.No.2613/2012-V4, dated 25.07.2018 addressed by the Divisional Forest Officer (FAC), Krishna Division, Vijayawada to the Chairman State Level Committee (W.B.I) & The Principal Chief Conservator of Forests (HoFF), Andhra Pradesh is placed on record by the learned Government Pleader. In the said letter, it is stated that the Divisional Forest Officer, Krishna Division, Vijayawada could not permit the shifting of saw mill since the DFO is not empowered to grant permission for shifting of Saw Mill location in view of Wood-Based (Establishment and Regulation )Guidelines, 2016 issued by the Ministry of Environment, Forest and Climate Change, Government of India. It is further stated that the applicant submitted a fresh application duly remitting prescribed licence fee as per A.P.

Wood based Industries (Establishment and Regulation) Rules, 2018 and by way of the said letter bearing Rc.No.2613/2012-V4, dated 25.07.2018 the proposals have been submitted to the State Level Committee and further action needs to be taken by the State Level Committee in this regard. 3.

In view of the above, Contempt Case is closed with a direction to the respondents to consider the request of the petitioner herein before the State Level Committee as expeditiously as possible. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
