THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition No.15836 of 2012 ORDER:

This writ petition is filed seeking the following relief/s: 'To issue a writ, order or direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in constructing the Toilets (Sulabh Complex) on the drainage in front of the shop of the petitioners at Masjid Chowk, Vijaya Talkies road, Hanmakonda, Warangal District is illegal and arbitrary and consequently direct the respondents to stop the construction forthwith and pass such other order of orders.'' [Reproduced verbatim] I have heard the submissions of the learned Standing Counsel appearing for the respondent. There is no representation for the petitioners on 29.09.2015 and also today. I have perused the material record.

The learned Standing Counsel appearing for the respondent would submit that no interim order was granted in this writ petition in favour of the petitioners and that the Sulabh complex (Toilets) were already constructed at Masjid Chowk, Vijaya Talkies road, Hanmakonda of Warangal District and that, therefore, the cause in the writ petition does not survive for adjudication and hence, the writ petition has become infructuous.

Recording the said submission, the Writ Petition is dismissed as infructuous. There shall be no order as to costs. Miscellaneous petitions pending, if any, in this writ petition shall stand closed.
