HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.32386 of 2018 ORDER:

This Writ Petition is filed, under Article 226 of the Constitution of India, seeking to declare the action of the respondents 4 and 5 in making phone calls to the petitioner and threatening to come to their police station without there being any compliant or case registered against him, as arbitrary and illegal.

Learned Assistant Government Pleader for Home produced written instructions, wherein it is stated that the respondent/police have received a complaint on 31.08.2018 from the husband of the petitioner and the same is entered in the reception register. Thereafter, the respondent-police forwarded the said complaint to the District Legal Service Authority, Nellore, for counselling. It is stated that after forwarding the same to the DLSA, the respondent-police intimated the same to the opposite parties for their appearance before DSLS. It is stated that only after receipt of report from DSLS, appropriate action will be taken and the respondent-police never threatened the petitioner to come to police station. 3.

In view of the same, the Writ Petition is disposed of directing the respondent-police to follow the guidelines laid down by the Apex Court in Arnesh Kumar v. State of Bihar and another1 as and when any crime is registered against the petitioner. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
