Heard learned counsel for the petitioner, learned Government Pleaders for Municipal Administration & Urban Development and Revenue, appearing for respondent Nos.1 and 3 respectively, and Sri S.Laxminarayana Reddy, learned Standing Counsel for GVMC, appearing for the second respondent, apart from perusing the entire material on record.
Earlier petitioner herein filed W.P.No.22996 of 2018, for the same relief, and this Court disposed of the said Writ Petition by way of an order, dated 06.07.2018. The said order reads as under: "When the matter is taken up, it is submitted by the learned Counsel for the petitioner that the respondent-Municipal Corporation authorities are trying to lay a road through middle of the land of the petitioner-Ashramam.
On the other hand, on instructions, Sri S.Laxminarayana Reddy, learned Standing Counsel for respondent-Municipal Corporation, submits that the land of the Ashramam is well protected by a fencing and the Municipal Corporation is not interfering with the possession and enjoyment of the same and not laying any road, as alleged in the writ petition.
The same is recorded and the writ petition is disposed of accordingly.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. No costs". In view of the above order, passed by this Court earlier, the present Writ Petition, for the self-same relief, cannot be maintained before this Court.
Accordingly, Writ Petition is dismissed. However, it is open for the petitioner herein to avail the remedies open under law. There shall be no order as to costs.
