THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL REVISION CASE No.2533 of 2016 ORDER:

The present Criminal Revision Case is filed under Sections 397 & 401 Cr.P.C. questioning the docket order dated 14.09.2016 passed in P.R.C. No.8/2016 on the file of the Judicial Magistrate of First Class, Prathipadu. 2.

A charge sheet came to be filed against the accused for the offences punishable under Section 323 IPC and Section 3(1)(r)(s) & 3(2)(va) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 for causing injuries to L.W.1, apart from abusing him by touching his caste.. 3.

While taking cognizance of the matter, it was found that the accused was not on bail. Hence, the Court issued non-bailable warrant to the accused. The said order is the subject matter of challenge in this Revision. 4.

Having regard to the facts and circumstances of the case, since the petitioner is aged about 63 years, non-bailable warrant issued against the petitioner shall be stayed for a period of two weeks. Meanwhile, the petitioner shall surrender before the Court concerned and move an application for bail, in which event, the petitioner shall be released on bail on executing a personal bond for Rs.20,000/- (Rupees twenty thousand only) with two sureties to the satisfaction of the trial Court.
