HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Transfer Criminal Petition No.221 of 2014 ORDER:

The petitioner/de-facto complainant seeks re-transfer of Sr.No.4203 of 2011 in Cr.No.112 of 2000 of Dabeerpura Police Station, Hyderabad from the Court of Chief Metropolitan Magistrate to the Court of VIII Additional Metropolitan Magistrate, Hyderabad.

Earlier she filed such a Tr.Crl.P.No.5 of 2014 before the High Court and the same was dismissed after an elaborate enquiry on 28.03.2014 with an observation that the petitioner can avail all the remedies available under law. Thereafter, petitioner filed Tr.Crl.P.No.1051 of 2014 before the Metropolitan Sessions Judge, Hyderabad and the same was also dismissed on 10.07.2014. Hence, the present transfer petition.

Learned Metropolitan Sessions Judge refused to transfer the case from Chief Metropolitan Magistrate Court to VIII Additional Chief Metropolitan Magistrate Court on the ground that merely because Chief Metropolitan Magistrate Court is a heavy Court is not a ground to transfer the case to VIII Additional Chief Metropolitan Magistrate Court as the said Court is also a heavy Court. Having regard to the above observation of the Unit Head who will have the comprehensive view over the pendency of each Court and rate of disposal etc., I find no irregularity in the said order. The petitioner could not make out any ground for transfer.

Accordingly, this Transfer Criminal Petition is dismissed. As a sequel, miscellaneous petitions pending, if any, shall stand closed. _________________________ U. DURGA PRASAD RAO, J Date: 13.02.2015 Murthy
