HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.42897 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to quash the proceedings against her in FIR No.198 of 2016 on the file of the 1st respondent. 2.

Heard and perused the material available on record. 3.

The above crime was registered for the offence under Sections 307, 353, 332 and 427 r/w 34 IPC alleging that while the police were checking the cars on the highway at Jaggaiahpet, Krishna District, the petitioner-A2 and her husband-A1 came in a car and when the police asked A1 to stop the vehicle, he moved his car front to back and drove it in high speed by damaging the bikes of the police and also tried to dash the police officers. It is the case of the petitioner that the allegations made in the complaint are false.

On 9.12.2016, this Court passed interim order directing the police concerned not to arrest the petitioner.

Considering the circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, the interim order dated 9.12.2016 is made absolute directing the respondents-police concerned to complete the investigation and file a final report, without arresting the petitioner. The petitioner is directed to appear before the Station House Officer concerned weekly twice in between 10 a.m., and 5 p.m., for one month. She is also directed to execute a personal bond for a sum of Rs.5,000/- (Rupees Five Thousand only) with one surety for the like sum to the satisfaction of the Station House Officer concerned, as surety for

her future appearance as and when required for the purpose of investigation.

With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ________________ RAJA ELANGO, J Date: 27th December, 2016 Nn
