HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 25683 of 2017 Order:

Heard learned counsel for the petitioners and learned Standing Counsel for the second respondent.

The petitioners state that they are small farmers having agricultural lands in Tallampadu and some of them have lost their lands for the purpose of constructing SRSP Canal. While so, they state that the Government of India proposed to widen the National Highway Road No.365A and entrusted the work to the second respondent. It is stated that in the process, the land of the petitioners is being interfered with, without following due process of law and alleging interference of the second respondent the present Writ Petition is filed. Learned Standing Counsel for the second respondent submits that no notification is issued as of now and only measurements are being taken for the purpose of proposed acquisition. As and when acquisition takes place, they will follow due process of law.

In view of the statement made by the learned Standing Counsel for the second respondent, this Writ Petition is disposed of directing the second respondent not to interfere with the land of the petitioners without following due process of law. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
